1. Introduction and Acceptance
These Terms & Conditions (“Terms”) govern your use of the website reimagine.nu and its AI-powered portrait generation tools (the “Service”). This Service is operated by KPI Communications A/S, CVR: 30179390 and utilizes infrastructure provided by Google Firebase and Simply. By using the Service, you agree to these Terms, our Privacy Policy and the Google Generative AI Additional Terms of Service.

2. Eligibility

You must be at least 18 years of age to use this Service. This Service is intended for users residing in Denmark. The Service is a marketing and artistic initiative and does not provide professional certification or factual documentation.

3. Description of AI Service (Google Nano Banana)

The Service utilizes Google’s Gemini Nano Banana and Nano Banana Pro models to generate images based on your prompts.

Experimental Nature: Generative AI is experimental and may produce inaccurate or unexpected results. The Campaign does not guarantee the accuracy of any output.
SynthID Watermarking: All generated images contain a digital SynthID watermark (both visible and/or invisible) to identify the content as AI-generated. You are strictly prohibited from attempting to remove or obscure these watermarks.
4. User Conduct and Content Restrictions

You are solely responsible for the content you upload and the prompts you provide.

Consent & Deepfakes: In accordance with Section 73 a of the Danish Copyright Act, you are prohibited from generating realistic digital imitations (deepfakes) of any natural person without their express, individual consent.
Prohibited Uses: You may not use the Service to generate content that is defamatory, obscene, promotes hate speech, or depicts illegal acts.
Safety Guardrails: The Service includes filters to prevent the generation of famous third-party intellectual property. Any attempt to bypass these safety measures or reverse-engineer the AI models is a violation of these Terms.
5. Intellectual Property
Your Content: You retain ownership of the photos you upload. You warrant that you have all necessary rights to use these photos.
AI Outputs: Google does not claim ownership of the generated images. You are granted a non-exclusive right to use the generated portraits for personal, non-commercial use. We further refer you to the relevant Terms and Conditions: Google Cloud & AI Prohibited Use
Campaign Property: All branding and technical assets of the Reimagine Campaign and KPI Communications A/S are protected by copyright and trademark laws.
7. Waiver of Right of Withdrawal (Fortrydelsesret)

Under the Danish Consumer Contracts Act (Forbrugeraftaleloven), digital content that is not supplied on a tangible medium is subject to a 14-day right of withdrawal. However, by clicking “Generate” (or similar), you provide prior express consent for the performance to begin immediately and acknowledge that you thereby lose your right of withdrawal.

8. Limitation of Liability

The Campaign and its partners provide the Service “as is.” To the maximum extent permitted by Danish law, we are not liable for any indirect, incidental, or consequential damages resulting from AI-generated errors or service interruptions. Our total liability is capped at the amount paid by the user (if any) or a maximum of 100 DKK. We do not exclude liability for gross negligence (groft uagtsomt).

9. Governing Law

These Terms are governed by the laws of Denmark. Any disputes shall be settled in the courts of Denmark.
